Terms and Conditions for the Package of 3 Semester-Long Courses at Varia Centrum Języka Polskiego Sp. z o.o.
These Terms and Conditions set forth the rules for participation in group classes organized as part of the “3-Semester Course Package” program. Making a payment and receiving confirmation of that payment constitutes full acceptance of these provisions, which form an integral part of the agreement entered into.
§ 1 CREATION OF THE GROUPS, FUNDAMENTAL RULES
- Enrollment in the course takes place after completing the registration form (online or at the school’s office), successfully submitting it or delivering it to the office, and paying the full fee for the entire package in advance.
- In order to determine a student’s proficiency level before the start of the first course, the student must take an oral test with an instructor—except for those starting from scratch, those continuing their studies at Varia School, and those who hold a certificate of completion for the previous level or an international language diploma.
- The results of the free placement test on the website can be used for an initial assessment of a student’s level, but they do not replace an oral test.
- The instructional groups are created based on the Students’ language ability, age, and individual needs.
- The course is designed for Students over 15 years of age.
- Upon the class commencement, it is permissible for the Student to change course level (to a higher or a lower one) with Varia’s approval.
- The number of Students in a group vary from 5 to 14.
- The courses included in the Package must be taken consecutively (semester after semester, with no breaks between consecutive sessions).
- If a scheduled group at a given level cannot be formed due to an insufficient number of participants, the School will offer the student an alternative solution (e.g., online classes, classes in another group at a similar level, or a modification of the course format). Due to the promotional nature of the offer and the fact that payment for the entire Package is made in advance, the standard automatic refund does not apply in this case.
- If, after the course begins, the number of students in the group drops below 5, the School reserves the right to offer students the option of continuing their studies in another group at the same proficiency level or to conduct classes with a reduced number of hours, while ensuring that the course curriculum is fully covered.
- The school reserves the right to change the instructor during the course for important organizational reasons and does not guarantee that classes at the next level will continue with the same instructor.
- The school requires students to be punctual, to actively participate in the course, and to prepare for classes conscientiously and thoroughly. Students must not disrupt classes, use equipment that interferes with the group’s work, or behave in a manner contrary to the norms of social coexistence, particularly with regard to religious and national sentiments.
- The school does not issue refunds for a student’s absences from class.
- In case of a Teacher’s absence, technical issues, or other unforeseen circumstances, the School will provide a substitute or reschedule classes to a date convenient for all Participants.
- The school reserves the right to record classes for educational purposes for internal use only, without sharing them with third parties.
§ 2 CERTIFICATES, TESTS, CONFIRMATIONS (RESIDENCE CARD)
- To advance to the next level of instruction within the Program and receive a certificate, students must meet the following requirements: a minimum attendance rate of 60%, a passing score on the final exam (at least 60%), regular completion of homework assignments, and a positive evaluation from the teacher.
- A student who did not take the final exam on the date set for the group is required to take the exam as soon as possible.
- When purchasing this Package, it is not possible to obtain a certificatethat can be used to apply for a temporary residence permit (a so-called residence card) or a visa.
- At the student’s request, the school may issue only a confirmation of course enrollment and a receipt for payment.
- The student is required to select and register for a course group before the start of each subsequent semester covered by the Package. Failure to select a group or to register the intention to continue the course by the required deadline will result in the loss of the opportunity to participate in that semester. In such a case, the Student is not entitled to extend the duration of the Package, transfer the unused portion of the course to another date, or receive a refund of all or part of the fee paid.
§ 3 PAYMENT FOR THE COURSE
- The fee for the “3-Semester Course Package” must be paid in full before the first class begins, in accordance with the terms of the promotional offer.
- The price of the Package includes an administrative fee to cover the preparation, organization, and administration of the courses offered as part of the Package.
- The promotional price of the Package includes, for each of the three semesters: Polish language classes, additional teaching materials (excluding the textbook and workbook), a placement test, a final exam, and a certificate of course completion, issued upon fulfillment of the conditions specified in § 2 of the Regulations.
- Payments can be made in cash or by card at the School’s office, or by bank transfer to the School’s Varia bank account (mBank S.A.) listed on the School’s website. The student is responsible for all costs and bank fees associated with making the payment, including the costs of domestic and international transfers.
- The fee for the Package is a flat rate—it is non-refundable, cannot be broken down into individual semesters, and cannot be applied toward other products offered by the School, in particular private lessons or exam fees.
- The purchase of the Package cannot be combined with other promotions, discounts, or special offers organized by the School. In particular, coupons and discount codes (Varia100), vouchers, and other permanent or temporary promotions and special offers announced by the School do not apply to the purchase of the Package, unless the terms of a given promotion expressly state otherwise.
§ 4 WITHDRAWAL FROM THE AGREEMENT AND CANCELLATION
- If enrollment is completed outside the school’s premises (e.g., online via the website), the student has the right to cancel the contract without giving a reason within 14 days of the date of payment.
- The right to withdraw from the contract referred to in paragraph 1, expires upon the start of the course (i.e., the start of the first class of the first semester), provided that this occurred within 14 days of the contract’s conclusion with the Student’s express consent. Once the course begins, the Student loses the right to withdraw from the contract and to receive a refund of the fee paid.
- If a student enrolls directly at the school’s campus, he or she is not entitled to withdraw from the contract.
- 14 days after the date the fee for the Package was paid or upon the start of the course—whichever occurs first – the Student is not entitled to cancel the Package or to a refund of all or any part of the fee paid.
§ 5 WARRANTY COMPLAINTS
- Every student has the right to file a complaint regarding the organization or conduct of the course.
- Complaints must be submitted in writing to the school’s office or electronically to the following address: info@kurspolskiego.pl, no later than 7 days from the occurrence of the circumstances giving rise to the complaint.
- A complaint must include, at a minimum: the student’s identifying information, a description of the circumstances that are the subject of the complaint, and an indication of how the student expects the complaint to be handled.
- The school will review the complaint within 7 days of receiving it and will notify the student of its decision via email.
- If a complaint is deemed valid, the School will determine how to rectify the issue or the form of any compensation, taking into account the circumstances of the case.
