One-Year Polish Language Course By-laws (visa courses)

§ 1. REGISTRATION FOR THE ONE-YEAR COURSE

Enrollment in the course takes place after the completed application form has been successfully submitted to the School (online or at the School’s office) and accepted by the School. Simply filling out or submitting the application form does not constitute enrollment in the course. Once the School has accepted the application, the student receives a contract for participation in the annual Polish language course (for visa purposes) (hereinafter: “the Contract”). After signing the Agreement and paying the full course fee, the Student is required to submit the following documents and information to the School’s office:

  1. bank confirmation of payment of the Course fee,
  2. a scan of the first page of the passport,
  3. the completed and signed agreement,
  4. information about the start date of the course,
  5. the address to which—at the student’s request and for an additional fee of 45 PLN (10 EUR)—the certificate may be mailed, or information on how to pick up the certificate in person at the school’s office.

§ 2. PAYMENT FOR THE ONE-YEAR COURSE

  1. The Student is obliged to pay the full course fee within 5 days from the date of signing the agreement.
  2. The course price includes an administrative fee of 900 PLN for preparing and organizing the course, reserving a place in the group, and issuing the certificate.
  3. The course price includes:
    1. a certificate of participation in the course to be submitted to the authorities,
    2. 250 hours of Polish language and culture classes in the form of group courses (semester and intensive courses) and individual lessons,
    3. workshops and lectures,
    4. integration meetings,
    5. a set of textbook and workbook (one set),
    6. additional learning materials,
    7. the Varia Club discount card,
    8. access to the student panel,
    9. placement test,
    10. final test,
    11. course completion certificate.
  4. Payments can be made either in cash, by card, or by bank transfer to the below listed account:

All bank fees are the responsibility of the Student.

§ 3. CANCELLATION OF THE COURSE

Cancellation rules:

  1. If enrollment is completed outside the school’s premises, the student may withdraw from the course within 14 days of the payment date:
    – without having to provide a reason, if the withdrawal occurs before the Certificate is issued,
    – without having to provide a reason; however, if the withdrawal occurs after the Certificate is issued, the amount refunded will be reduced by an administrative fee (900 PLN).
  2. If the Student receives a refusal of a visa or residence permit before or after the start of the course (for a reason other than the Student’s absence from the Course classes), the Student may submit a written statement terminating the agreement with immediate effect within 7 days from the date of receiving the refusal and must send a scan of the refusal decision.
  3. If the refusal is received before the start of the course and the refusal decision and termination statement are submitted within 7 days, the Student receives a refund reduced by administrative costs (900 PLN).
  4. If a visa or residence card is denied after the course has begun (for a reason other than the Student’s absence from course classes) and if the Student submits the aforementioned decision along with a statement terminating the contract with immediate effect within 7 days of receiving the denial, the Student will receive a refund of the amount paid, minus administrative fees (900 PLN), the cost of textbooks received, and the cost of lessons already taken.
  5. If the Student fails to send the School a scan of the decision denying a visa or residence card, along with a statement terminating the Agreement with immediate effect, within 7 days of receiving the denial decision, they lose the right to terminate this Agreement with immediate effect and to receive a refund of the Course fee paid. In such a case, the School will enable the Student to participate in the Course online at the earliest possible date, which the School will notify the Student of.

  6. A denial of a visa or residence permit does not entitle the Student to request a refund of the amount paid as the Course fee or to terminate the contract with immediate effect, if the refusal is due to the Student’s absences from the classes for which they were enrolled. In such a case, the Student will be able to continue the Course online at the earliest possible date specified by the School.
  7. Ceasing participation in classes does not equate to terminating the agreement and does not exempt the Student from the obligations.
  8. The Student’s failure to attend classes during the period specified in the agreement and in the certificate does not constitute grounds for requesting a refund of the fee paid or for demanding that the classes be held at a time other than the one specified in the certificate.
  9. The paid amount is not refundable if, after receiving the relevant certificate from the School, the Student withdraws from applying for a visa or residence permit without providing a decision refusing the issuance of a visa or residence permit and submitting a statement of termination of the Agreement with immediate effect.
    In such a case, the Student will have the option to start or continue the course online at the nearest possible date indicated by the School.
  10. The Student is required to send the School the received decision refusing the issuance of a visa or residence permit to the email address info@kurspolskiego.pl within 7 days from the date of its issuance.
    If the Student wishes to withdraw from the course, the Student is required to submit a statement of termination of the Agreement with immediate effect within 7 days from the date of receiving the refusal decision.
  11. The refund of the amount paid will be made within 14 days from the date the School positively considers the Student’s request.

§ 4. CONFIRMATION LETTER

  1. After paying the full course fee and submitting the signed agreement, the Student will receive an electronic Confirmation Letter (PDF) confirming their enrollment in the annual Polish language course at the Varia Polish Language Center within 14 days from the date of payment.
  2. The confirmation letter can be presented to the relevant authority to apply for a visa or to legalize residency in Poland.
  3. The confirmation letter is issued for one year.
  4. The confirmation letter in a name of one Student.
  5. It is not possible to transfer the Confirmation Letter to another person.
  6. It is not possible to attend classes on dates other than those specified in the Confirmation Letter and the agreement.

§ 5. CREATION OF THE GROUPS, FUNDAMENTAL RULES

  1. The Students (with the exception of students starting their Polish education, students continuing their education at Varia) is required to take a placement test and/or participate in an interview with a Varia teacher.
  2. A free placement test is provided for the Student’s convenience on Varia’s web page www.varia-course.com.
  3. The instructional groups are created based on the Students’ language ability, age, and individual needs.
  4. The course is designed for Students over 15 years of age. Persons under 18 years of age are required to provide a written statement from their legal guardian confirming consent for the Student to participate in the course.
  5. Upon the class commencement, it is permissible for the Student to change course level (to a higher or a lower one) with Varia’s approval.
  6. The number of Students in a group vary from 5 to 14.
  7. The School reserves the right to change the Teacher during the course because of unforeseen circumstances.
  8. Varia requires all Students to be punctual, actively participate in the course, and prepare for classes diligently and conscientiously. Students must not disrupt classes, use mobile phones or other devices that interfere with the work of the group during lessons, or behave in a manner that is contrary to generally accepted standards of social conduct, in particular with respect to religious and national sensitivities.
  9. Students are not reimbursed for their absences.
  10. In the event of unexcused absences exceeding 60% of the classes, a student may be removed from the student roster.
  11. In case of a Teacher’s absence, technical issues, or other unforeseen circumstances, the School will provide a substitute or reschedule classes to a date convenient for all Participants.
  12. The School reserves the right to record the image, the voices, and statements of Students, as well as to take photographs, make audio and video recordings, and create other materials documenting classes, events, and activities organized by the School, both on School premises and off-site. These materials may be used by the School for educational, promotional, and marketing purposes, in particular through publication on the School’s website, on the School’s social media, and through other channels of communication and promotion of the School’s activities. The School may use the above materials to showcase its educational activities, document the courses it offers, and create teaching materials. The School undertakes to use the materials while respecting the rights and personal interests of the Students and in accordance with applicable regulations regarding the protection of personal data.

  13. The Student’s acceptance of these Terms and Conditions constitutes consent to the recording and use of their likeness, voice, statements, and other materials referred to in Section 12, Paragraph 5, for educational, promotional, and marketing purposes, in accordance with the terms set forth in these Terms and Conditions.
  14. In case of any suggestions or concerns, please contact your Teacher, the Office, or the Management.
  15. The School will provide the certificate issued to the Student and information regarding the participant’s classes upon request from customs services or any office for foreigners.

§ 6. CERTIFICATES, TESTS

  1. To obtain a course certificate a Student has to participate in at least 60% of lessons during the semester course and receive a positive grade from the final exam (min. 60%).
  2. The conditions for promoting the Student to the next, higher level are: achieving a positive result on the final test (minimum 60%), at least 60% attendance in classes, regular completion of homework, and a positive teacher’s evaluation of the Student’s work in lessons and progress in learning.
  3. A Student who did not take the final test on the date scheduled for the group is obliged to take the test at the earliest possible date.
  4. At the Student’s request, Varia will provide a course completion certificate.

§ 7. WARRANTY CLAIMS

  1. Every Student has a right to file a warranty complaint. The warranty claim can refer to the teaching methods and/or organizational issues.
  2. A warranty claim can be submitted:
    1. at the office of VARIA Polish Language Center Ltd.,
    2. via email sent to: info@kurspolskiego.pl.
  3. A properly submitted complaint should include the following information:
    1. identification of the Student (first name, last name, residential address, email address),
    2. a description of the event that forms the basis of the complaint,
    3. the Student’s expectations regarding the resolution of the complaint.
  4. Complaints must be submitted within 7 days from the date the event occurred.
  5. The School will review the complaint within 7 days of its receipt.
  6. The Student will be informed of the complaint resolution via email.
  7. The form of any individual compensation will be determined together with the Student.
